These Terms of Service ("Terms") govern your access to and use of Island Intellects, including our website, mobile experience, practice quiz tools, and tutor marketplace (collectively, the "Platform"). Island Intellects is operated by Island Intellects ("we", "our", or "us"). By creating an account or using the Platform, you confirm that you have read, understood, and agreed to these Terms.
If you are creating an account on behalf of a minor, you confirm that you are their parent or legal guardian and that you accept these Terms on their behalf.
Acceptance of Terms
By accessing or using Island Intellects in any way — including browsing the website, registering for an account, or using any features of the Platform — you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Platform.
We reserve the right to update these Terms at any time. When changes are made, we will update the effective date at the top of this page and, where appropriate, notify users by email. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
Account Types & Responsibilities
Island Intellects offers three account types, each with distinct roles and responsibilities:
Student Accounts
Student accounts are for learners preparing for Common Entrance/CPEA or CXC/CSEC exams. Students (or their parent/guardian) are responsible for maintaining the security of their login credentials and for all activity that occurs under their account. Students must not share their account with others.
Parent Accounts
Parent accounts allow a parent or guardian to monitor their child's progress and manage their subscription. By creating a student account for a minor, parents consent to the Platform's data practices as described in the Privacy Policy. Parents are responsible for ensuring their child uses the Platform in accordance with these Terms.
Tutor Accounts
Tutor accounts are for qualified educators who wish to offer 1-on-1 tutoring sessions through the Platform. Tutors must provide accurate information about their qualifications and experience during the application process. Tutors are responsible for maintaining professional conduct in all interactions with students and parents. See Section 5 for tutor-specific terms.
Plans & Pricing
Island Intellects offers the following plans for student and parent accounts:
All prices are displayed in local currency where applicable. The Student Plan automatically renews monthly until cancelled. You may cancel your subscription at any time from your account settings or by contacting us at learn@islandintellects.com. Cancellations take effect at the end of the current billing period — you will retain access until then.
We reserve the right to adjust pricing with reasonable notice to users. Existing subscribers will be notified at least 30 days before any price change takes effect.
Payments & Billing
All payments are processed securely by Stripe. By providing your payment details, you authorise Island Intellects to charge you for the plan you have selected, including recurring charges for subscription renewals.
- Payment is due at the start of each billing cycle. If a payment fails, your account may be downgraded to the free plan until payment is resolved.
- All prices are displayed in local currency. Currency conversion, where applicable, is handled at the time of transaction by Stripe.
- We do not store credit card numbers. Payment information is held by Stripe in accordance with PCI-DSS standards.
- Refunds are handled on a case-by-case basis. To request a refund, contact us at learn@islandintellects.com within 14 days of a charge.
Tutor Terms
Tutors who join the Island Intellects platform agree to the following additional terms:
Rates & Commission
- Tutors set their own hourly rates for sessions booked through the Platform.
- Island Intellects retains a commission on each session. The exact commission rate will be communicated during the tutor onboarding process and may be updated with prior notice.
- Payments are disbursed to tutors following completed sessions, subject to Stripe's processing timelines.
Professional Conduct
- Tutors must maintain professional, respectful conduct in all communications and sessions with students and parents.
- Tutors must not solicit students to arrange sessions or payments outside of the Platform.
- Tutors must ensure they have the qualifications and experience they represent in their profile.
- Island Intellects may suspend or remove a tutor's account for violations of these conduct standards, as determined in our sole discretion.
Independent Contractors
Tutors using the Platform are independent contractors, not employees of Island Intellects. Island Intellects does not control the manner or method by which tutors deliver their services, and is not liable for the quality or outcomes of tutoring sessions.
Educational Content
All practice questions, explanations, and educational materials available on Island Intellects are provided for educational purposes only. The content is designed to align with Caribbean curriculum standards, including Common Entrance/CPEA and CXC/CSEC syllabuses.
- Content is intended to supplement — not replace — formal schooling and teaching.
- While we take care to ensure accuracy, we cannot guarantee that all content is free from errors. If you identify an error, please report it to learn@islandintellects.com.
- All content on the Platform is the intellectual property of Island Intellects or its licensors. You may not copy, reproduce, or distribute any Platform content without our written permission.
Prohibited Conduct
By using Island Intellects, you agree not to:
- Share accounts: Each account is for a single user. Sharing login credentials or allowing others to use your account is prohibited.
- Engage in academic dishonesty: Using the Platform in ways that violate your school's academic integrity policies (e.g., accessing it during a supervised exam) is prohibited. Island Intellects is a study tool, not a cheating aid.
- Harass or abuse others: No harassment, bullying, threatening, or abusive behaviour toward other users, tutors, or Island Intellects staff.
- Attempt to circumvent the Platform: Do not attempt to access areas of the Platform you are not authorised to access, or to reverse-engineer or disrupt the Platform's operation.
- Misrepresent yourself: Do not provide false information in your account profile or during the tutor application process.
- Use the Platform for commercial purposes without permission: You may not use Island Intellects content or data for commercial redistribution.
Termination
You may delete your account at any time by contacting us at learn@islandintellects.com. Upon deletion, your access to the Platform will be revoked and your personal data will be handled in accordance with our Privacy Policy.
Island Intellects reserves the right to suspend or permanently terminate any account, with or without notice, if we determine that:
- The account has violated these Terms of Service
- The account has engaged in fraudulent or illegal activity
- Continued access poses a risk to the safety or integrity of the Platform or other users
Where a paid subscription is terminated for a violation, no refund will be issued for the remaining subscription period. If we terminate an account in error, please contact us and we will review the situation promptly.
Limitation of Liability
Island Intellects provides the Platform on an "as is" and "as available" basis. While we strive to maintain a reliable, high-quality service, we do not guarantee that:
- The Platform will be available at all times or free from technical errors
- Practice questions will exactly replicate the format or difficulty of any specific exam
- Use of the Platform will result in improved exam scores or academic outcomes
To the fullest extent permitted by applicable law, Island Intellects shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the Platform. Our total liability to you for any claim shall not exceed the amount you paid to us in the three months preceding the claim.
Nothing in these Terms limits our liability for fraud, death, personal injury caused by our negligence, or any other liability that cannot be excluded under applicable law.
Changes to These Terms
We may update these Terms of Service from time to time to reflect changes in our services, legal requirements, or business practices. When we make significant changes, we will notify registered users via email at least 14 days before the changes take effect.
The effective date at the top of this page always reflects the most current version of the Terms. If you continue to use Island Intellects after updated Terms take effect, you are agreeing to the revised Terms.
